The NPA has now indicated that they refuse to prosecute Malema at this point in time in relation with the well known fraud case. The case revolves around his family trust’s involvement in a fraudulent scam to set up a tender management unit for roads contracts for the Limpopo provincial government in 2009.

The Public Protector also found in an investigation afterwards that the whole thing was a scam and that about R52 million was illegally defrauded. Malema was directly involved through his family trust, the Ratanang Trust, which was a shareholder in On Point Engineering, accused of setting up the tender, falsifying tender documents.

The case has been postponed numerous times. It was eventually struck from the roll in 2015 by the judge when the case was not ready to proceed that day because a co-accused in the matter called in sick. When a case is struck off the roll, the State has the means to re-enroll the case but the NPA, seemingly terrified of Malema, never did so.                     
Afriforum asked that the State re-enroll the case a year and a half ago and make a decision. The NPA has now made a decision, leaving Malema out of the case and only agreeing to charge the co-accused in the matter.   

Adv Gerrie Nel, Head of AfriForum Private Prosecuting Unit, will privately prosecute Julius Malema and co accused for fraud and tender corruption should the National Prosecuting Authority (NPA) not yield to AfriForum demand that the case against Malema, regarding the then corrupt activities of the company On Point Engineering in Limpopo, be reinstated.
                                       
This is a classic repeat of what the NPA did when they left Zuma out of the case in which only his accomplice Schabir Schaik was charged.
