In a court application, the Cape Party filed complaints against the Iziko SA National Gallery.
The gallery has exhibited posters showing the words “F … White People”.
The presiding magistrate, Daniel Thulare, in his statement said that it is not hate speech or racist in nature, but the expression is art.
Observers point out that this verdict can create a dangerous precedent. Although it is a judgment in a lower court, it does not automatically rule out jurisdiction for future matters, but then an appeal against the ruling should be lodged.
But it is not clear, what the difference between the expression of art or freedom of expression on someone’s social media might be.
