Two men accused of involvement in a conspiracy to obtain vehicle financing fraudulently, appeared in court on Monday.
Thesville Leaton Ovis and Nezaamodien Narker appeared in the Specialised Commercial Crime Court, before magistrate Sabrina Sonnenberg, who warned them to appear again on November 14.
Prosecutor Jacques Smith told the court that Ovis wished to negotiate a plea bargain, via defence attorney Zirk Makay, and that the plea bargain, if successful, would be presented to the court at the next hearing.
Defence counsel advocate Ross McKernan said Narker would “decide his strategy” only after Ovis’s plea bargain had been formally signed.
It is alleged that the two men were part of a wider conspiracy with people “unknown to the State”, in an ongoing scam to purchase cars with financing fraudulently obtained.
It is alleged that Ovis submitted an application for vehicle financing to Leana McGregor, the business manager at Volkswagen Cape City, in Cape Town, for the purchase of a Volkswagen Golf for R564 748 and a Volkswagen Polo for R379 857.
The State alleges that the application included false documentation pertaining to his salary, as well as a false bank statement.
It is alleged that Ovis obtained the false documentation from Narker.
The charge sheet alleges that Wesbank approved the financing, and that the two cars were delivered to Ovis – never to be recovered.
It is alleged that Ovis and Narker, together with others involved in the conspiracy, but unknown to the State, generated forged bank statements with the unlawful use of Nedbank’s stationery.
Similarly, they generated forged salary slips, all in common purpose with others involved in the conspiracy, it is alleged.
The two face four charges – conspiracy to commit fraud, fraud, and two of forgery.
