The Cape Town City Council has filed an application to the High Court in Johannesburg against the minister of energy, Mmamaloko Kubayi, asking that the city be allowed to purchase electricity from independent power companies.
The council therefore asks the court to declare that power suppliers do not need to obtain ministerial approval to generate and sell electricity to the city.
Should the application be granted against the minister, and in effect against Eskom, it opens the way for other councils and municipalities to buy electricity from any provider other than the bankrupt and corrupt semi state institution.
