Dr. Wouter Basson’s application in the appeal court passed.
Earlier, he appealed against an order rejecting his application that two members of the medical board should be excused in his trial because of prejudice against him.
Judge Shongwe upheld Basson’s appeal on Wednesday, rescinded the previous Gauteng High Court ruling, and ordered the medical council to pay the costs of the application.
