Cape Town man to be sentenced next month for use of k-word

The absence of a report in court on Friday delayed the sentencing of a man who verbally abused a shop assistant using the derogatory k-word.

The incident happened in November last year at Lino’s Tuck Shop in Gunner’s Circle, Pinelands, where Bruce Allan, 35, wanted assistance to play the Lotto.

Allan, of Taylor Street, Parow Valley, in Cape Town’s northern suburbs, appeared in the Goodwood District Court on Friday where magistrate Sean Lea was to sentence him on a charge of crimen injuria.

However, prosecutor Moosa Adonis told the court that a correctional supervision report, required for sentencing purposes, had not yet arrived, and at his request the case was postponed to June 24.

The awaited report will indicate whether Allan is suitable for a sentence of correctional supervision, either involving a short period of imprisonment, to be followed by house arrest, or house arrest without imprisonment.

Allan pleaded not guilty in March, but was found guilty last month and was to have been sentenced on Friday.

A witness to the incident, who also works at the tuck shop, told the court she heard Allan asking the victim for assistance to play the Lotto.

Her testimony took the form of a sworn affidavit which formed part of the court record.

The victim was busy cleaning the refrigerator in the shop and had asked Allan to wait.

The witness said Allan, when asked to wait, started swearing at the victim, calling her a k*****, a f***** b**** and a “bobbejaan” (baboon).

He went on to say that the staff were uneducated, did not belong in the Western Cape, and that they should return to the Eastern Cape.
