A 37-year-old woman accused of kidnapping a 9-day-old baby has been granted R4,000 bail under strict conditions, sparking outrage from the victim’s family and child rights activists.

The suspect, whose identity has not been disclosed, faces charges of kidnapping and defeating the ends of justice in connection with the disappearance of the infant from the MediClinic Mall in Bellville. The Magistrate ruled that the state failed to prove she would interfere with witnesses or violate bail conditions.

Bail Conditions Imposed

The accused must:

  • Avoid the Mitchells Plain area.

  • Report regularly to a police station.

  • Comply with additional restrictions pending trial.

The decision left the baby’s mother visibly distraught in court, where she broke down and declined to speak to the media. Relatives of the accused indicated they would post bail immediately, paving the way for her release.

Activists Condemn Bail Decision

Veronique Williams, founder of a missing children’s organization, slammed the ruling, calling it a failure of the justice system.

“There’s no way a kidnapper or a person of interest in a child’s disappearance should get bail,” Williams said. “The system is failing our community. This child was an innocent angel—why should we be fair to someone who showed no fairness to the mother?”

The Magistrate noted the absence of a social worker’s report regarding the accused’s three minor children as a factor in granting bail. However, Williams argued that premeditated crimes against children should warrant stricter denial of bail.

Case Background

The infant was allegedly abducted at just seven days old, triggering a widespread search before being safely recovered. The trial is expected to proceed despite the bail ruling.

As the suspect prepares for release, tensions remain high, with activists urging the public to hold the justice system accountable.
