NORTHERN CAPE – Kimberley Specialised Commercial Crime Court has convicted and sentenced former Head of Department in the Department of Health in the Northern Cape, Dr Dion Garvey Theys on Wednesday, 16 August 2023, on three (3) counts of Contravention of the provisions of section 86(1) of the Public Finance Management Act.

During March 2014, Dr Theys used his position to sign three lease agreements with JP Hugo residence for nursing accommodation without following proper procurement processes. The total cost of these lease agreements are in excess of R96 million.

Dr Theys was arrested in March 2021 by the Hawks Serious Corruption Investigation team and made numerous court appearances until his sentencing.

Dr Theys was found guilty today on all counts and was sentenced as follows:

He was sentenced to a fine of one hundred and fifty thousand rand (R150 000.00) or three (3) years imprisonment of which one hundred thousand rand (R100 000.00) or two (2) years imprisonment is suspended for a period of five (5) years on condition that the accused is not found guilty of Contravention of Section 86 (1) of the Public Finance Management Act, Act 1 of 1999 committed during the time of suspension. Accused has been declared unfit to possess a firearm.

The Provincial Head of the Directorate of Priority Crime Investigation, Major General Stephen Mabuela congratulated the team for securing a great sentence.
