Rapist gets two life sentences plus 22 years

The North West provincial police management welcomed two life sentences and 22 years imprisonment handed down to Goitsemang Johannes Phukuntsi (34) by Klerksdorp Regional Court on Tuesday, 22 May 2018.

Phukuntsi’s sentencing follows his arrest on Tuesday, 7 March 2016 for three counts of rape and two of housebreaking that were committed between 2010 and 2013.

It was reported that Phukuntsi raped a 14 year old minor in November 2010 in Jouberton. In another incident, he raped a 23 year old woman inside the toilet in March 2012. He forcefully took the victim to his father’s house in Khuma where he threatened her with a knife and repeatedly raped her.

In the third incident in July 2013, Phukuntsi broke into a house of a 57 year old woman in Jouberton. He then took the woman’s clothes before raping her in front of her children.

The accused was sentenced as follows: Count one: 5 years imprisonment for housebreaking, Count two: life imprisonment for rape, Count three: life imprisonment for rape, Count four: 5 years for imprisonment for housebreaking and Count five: 12 years imprisonment for rape.

The sentences will run concurrently. He was declared unfit to possess a firearm in terms of Section 103 of the Firearms Control Act, 2000 (Act No. 60 of 2000). The court also ordered that the accused’s particulars be included in the National Register for Sex Offenders in terms of Section 49 and 50(2) of the Criminal Law (Sexual Offences & Related Matters Amendment Act, 2007 (Act No. 32 of 2007).

The Provincial Commissioner of North West, Lieutenant General Baile Motswenyane commended the Klerksdorp Family Violence, Child Protection and Sexual Offences Unit (FCS) in ensuring that the accused receives a hefty sentence. “With this sentence, we are once more sending a clear message to criminals out there that those who commit crime will be shown no mercy,” said Lieutenant General Motswenyane.
