Suspect to appear in court for contravening Counterfeit Goods and Customs & Excise Act

A suspect (38) is expected to appear before the Komatipoort Magistrate’s Court on Thursday, 07 September 2023 for contravening the provisions of Section 83(a) & (b) of the Customs and Excise Act, Act 91 of 1964.

-Contravening the provisions of Section 2(1)(f) read with Sections 1,2(2),10,16,19 & 20 of the Counterfeit Goods Act, Act 37 of 1997 and read with the Trade Mark Act, Act 194 of 1993.

His appearance followed after he was arrested by Hawks Nelspruit based Serious Commercial Crime Investigation together with South African National Defence Force, Komatipoort SAPS and SARS Customs& Excise officials at Lebombo Port of Entry.

It is alleged that on Wednesday, 06 September 2023, members were busy performing their daily duties at N4 toll road near Lebombo Border Port of Entry at Komatipoort when they stopped and searched a DAF truck with two trailers which was traveling from Mozambique into the Republic of South Africa.

Upon the search, counterfeit goods (sneakers/tekkies), being Nike, New Balance, Diesel Lecoste and Reebok with estimated street value of R 4.5 million were found.

The truck and two trailers, together with the counterfeit goods were seized and confiscated for further Investigation.

The suspect was arrested and detained pending his first court appearance today.
