The Acting National Head of the Hawks Lieutenant General Yolisa Matakata has welcomed the sentence of Hlakaniphani Miya (33) who shot and killed Constable Sithembiso Sifiso Yende (38) a former member of the Ladysmith Tactical Response Team (TRT).

Lieutenant General Matakata thanked the Hawks members and all other stakeholders who worked behind the scenes as this result would not have been possible without their contribution.

“We understand very clearly that the sentencing will never bring back Constable Yende or take away the families hurt, but our justice system has made sure that Miya pay for his sins on this earth,” she said.

On 8 March 2014, Constable Yende from Ezakheni, reacted to cries of help from neighbors after they were attacked by three gun wielding robbers. While proceeding he was confronted by the three gun toting robbers who were shooting indiscriminately. In self-defense he shot one of the suspects later identified as Miya but was overwhelmed by the suspects.

The suspects fled the scene with his service pistol and Yende later succumbed to his injuries at the scene. The Hawks took over the investigations and a manhunt ensued. In no time feeling the heat, the three suspects handed themselves over to the investigating team.

Nkosiyakhe Mabaso (33), Thando Mabaso (31) and Miya were charged accordingly and appeared in court where they were granted bail. Whilst out on bail, the two Mabaso’s were fatally shot during a taxi rival at Ezakheni area.

On Thursday, 15 February 2018, the Pietermaritzburg High Court sentenced Miya to 22 years imprisonment for murder, ten years for possession of unlicensed firearm and five years for kidnapping of Yende’s neighbors. The sentences will run concurrently.
