Ironic. So many white people stood up for Pravin Gordhan in the past but he was the one who promulgated regulations which ensured only black companies can get tenders from the State. There is a big lesson in this story and that is to never stand up for any ANC member, including Pravin Gordhan and Cyril Ramaphosa. They are all rotten to the core and working hand in hand to commit economic murder against white people.

In 2017 it was Pravin Gordhan, as Finance minister, who promulgated regulations in terms of the Preferential Procurement Policy Framework Act 5/2000. The Preferential Procurement Regulations of 2017 promulgated by minister Gordhan (the Gordhan regulations) had as intention to regulate how state departments should interpret the law. In other words it gave the law teeth.

In short the regulations promulgated by Gordhan stipulated that any white owned business should be pre-disqualified in all bidding processes for tenders for any state department or state owned enterprise (SOE), even before looking at the merits of the bid. In short the regulations determined that if you are white, you are out when it comes to doing business with the State. Again we stress, this was Pravin Gordhan’s regulations, seen by some white people as a hero and savior.

This is also the same minister Pravin Gordhan who as minister for Public Enterprises is supposed to save the crumbling SOE’s. But how will he be able to do so when he was the one who implemented a state procurement policy which excludes an entire section of society on the basis of their skin colour?

By now all people should be aware how the state tender processes have morphed into a looting orgy with the only real criteria that a successful bid winner should be black, well connected and pay the required bribes. It was these racially discriminatory regulations promulgated by Gordhan which greatly contributed to the fast crumbling state. We are living in the era of a rotten to the core and totally incapable state because of regulations like the ones implemented by Gordhan in 2017.

However Sakeliga has just obtained an important court victory on Monday 2 November in the Supreme Court of Appeals (SCA) when the court found these regulations to be unconstitutional and invalid. Sakeliga was the applicant in the case.

The SCA court sitting in Bloemfontein found that the Gordhan regulations were in contradiction with Act 5 of 2000 and the Constitution.
The SCA found that minister Gordhan, who was then the Finance minister, acted ultra vires, or acting as if he has legislative powers.
The ruling that found the Gordhan regulations to be unconstitutional were suspended for 12 months to give the government time to rectify the regulations. So the government can still legally say ” if you are white you are out” for another year.

Analysis:

This is an important court victory but white people should not believe that this is the end of the ANC economic murder program. We have seen in the past how the ANC simply start to act outside of the law and ignoring the law when the courts rule against them. It is more than likely that they will continue to discriminate on the basis of race whatever the courts say. So the white minority will have to find another way to ensure economic survival and the obvious answer is to trade and do business amongst each other. So go and support the mom and pop businesses owned by your own kind. We can survive if we do business and trade with each other
