Public Protector Advocate Kholeka Gcaleka has revealed findings of improper conduct and maladministration by officials of the Enoch Mgijima Local Municipality in the controversial construction of the Lesseyton sports field near Komani.

The R20 million stadium, which drew public outrage for its shoddy workmanship, was found to have been marred by financial mismanagement, lack of oversight, and procurement irregularities. Gcaleka presented her findings during a media briefing in Bisho on Thursday.

Key Findings

  • The tender for the stadium was awarded to Thalami Civils for over R20 million, exceeding the budgeted amount of R18 million.

  • Municipal officials failed to provide clear service specifications to the company hired to design and oversee the project.

  • Some senior officials involved in the procurement process were promoted or moved to other municipalities despite their role in the mismanagement.

Gcaleka criticized the officials for failing to act in the public’s best interest, stating: “If you execute public power, you must do so with care… In this instance, senior officials—qualified in finance, supply chain, and municipal management—failed to ensure proper oversight, not only in procurement but also in contract management, leading to millions being wasted.”

Community Skepticism Over Remedial Actions

While the Public Protector has recommended that the municipality source funds to rectify the stadium, residents doubt this is feasible given the municipality’s financial crisis. One community member expressed frustration: “This is a cash-strapped municipality. If her recommendations are ignored, what consequences will there be for those responsible?”

Calls for Accountability

Traditional leaders have demanded that implicated officials face consequences. The Public Protector’s report also calls for:

  • Disciplinary action against responsible municipal officials.

  • Eastern Cape Premier Oscar Mabuyane to take corrective measures against Municipal Manager for failing to table a forensic report before the council and legislature.

  • The Minister of Cooperative Governance and Traditional Affairs to ensure accountability.

Enoch Mgijima officials declined to comment.
