The High Court in Port Elizabeth has been asked to declare all fines from January 2015, issued to motorists invalid.
According to the legal department of the Traffic Violation Specialists, the content of the fines and the notice to the offender is often incorrect and does not meet the requirements set out in the Criminal Procedure Act.
If the court rules in favor of the applicants, the order will be valid only for the municipality but it creates a precedent across the country where fines are erroneously issued.
The capabilities of certain traffic officials have long been a source of concern and the “offense” description is often turned into jokes.
