Nine workers were fired after an illegal strike in which they participated and sang the slogan “Kill the boer”.
The incident took place in May 2013 when the company ‘Duncanmec’ found them guilty during an internal hearing and reported that the employee/employer relationship was irreparable.
The case was referred to the Metal Engineering Council, which ordered the workers to be re appointed after which the Labor Court made the same finding against the company.
Now the Constitutional Court has to decide whether these ‘fight songs’ have a place in the workplace.
