
Eldoret, 4th May, 2026 – The High Court at Eldoret, Kenya, has dismissed claims brought in 2025 by former subcontractor, plaintiff, Green Planet Initiative (GPI) 2050 Foundation. The plaintiff had advanced various legal complaints relating to its former role in Earthbanc’s Regeneration Kenya Project.
Ruling in favour of Earthbanc AB and its Kenya subsidiary Earthtree Company Limited, the court rejected and denied each and every one of the pleadings and reliefs that had been sought by the plaintiff. The court ordered the plaintiff to pay the defendants’ costs.
In its decision, the court described the plaintiff’s suit as lacking “merit, legal foundation and substance on the face of it…” The court was also highly critical of the plaintiff’s conduct and accountability failures as a former implementing partner. The court stated that “a party who fails to perform his or her side of the bargain cannot enforce the contract against the other party.”
The plaintiff, GPI, had been contracted to support the implementation of the Regeneration Kenya project. The contractual relationship was terminated in April 2025 following internal reviews that indicated GPI was not meeting agreed compliance, operational and quality benchmarks. As reflected in the court record, the plaintiff confirmed that there are no amounts due or owing from Earthbanc AB.
