Land expropriation legislation paving the way for land grabbing

July 30, 2015 is the cut-off date to do submissions before the land expropriation legislation, which Jacob Zuma promised in January at the ANC Birthday celebrations, is launched through Parliament.

This proposed legislation will replace the 1975 Law on Expropriation of Property, which made allowance for property to be dispossessed if it is needed for infrastructure such as dams or roads.

The new law will become part of the Constitution and will:

  • Give power to the Minister of Public Works to expropriate any property which, in his opinion, is needed for the purpose of accommodation, land and infrastructure by government.
  • The owner of a property will be informed of the proposed expropriation and offered a price. He has 30 days to object and indicate what he regards as a decent remuneration for his property. If government does not accept his proposal, the property will be dispossessed at the price the Minister determines.

Zuma indicated that the reason for this new legislation is the fact that land reform is not happening fast enough and that the principle of “willing seller, willing buyer” is not working.

In actual fact then, this law is simply paving the way for land grabbing in exactly the same way Mugabe did it – only difference is that nobody will be able to object against government expropriating your farm, house or building, because it is written in the Constitution.

The only organisations submitting proposals on this matter this week are:

  • SA Institute for Race Relations
  • Escom Centre for Constitutional Rights
  • Mtata Tax payers Association
  • SA Catholic Bishops Conference
  • Agri SA
  • Cosatu
  • Solidarity.

We don’t expect strong opposition from any of them.

Attempts at launching such legislation through Parliament, failed in 2008 and again in 2013.

This time Zuma made it his mission to launch it through.

The legislation reminds us of collectivism, the Communist “nationalization” of property under Josef Stalin, which was the cause of famine and economic regression leading to the death of close on 30 million people in the Ukraine and USSR.

The impact of such legislation on food production, agriculture and industry is unimaginable. If nothing else, this is the nail in the coffin of the Rainbow Nation.

From this point onwards we are on a downhill slope towards becoming a Communist State at the expense of the minority population in South Africa. If we do not move to obtain self-determination soon, we will go down with this ship!
