Systematic means the attack was well planned by those who carried it out.\" title=\"crimes against humanity\">crimes against humanity<\/span>\u00a0in his alleged role as a Liberian former armed group commander is an important step toward justice for victims of\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/africa\/liberia\" rel=\"noopener\">Liberia&#8217;s<\/a>\u00a0first civil war, Human Rights Watch and the International Federation for Human Rights (FIDH) said today. The trial is scheduled to begin on October 10, 2022 in Paris, and is a sign of\u00a0<a target=\"_blank\" href=\"https:\/\/www.diplomatie.gouv.fr\/en\/french-foreign-policy\/international-justice\/news\/article\/jurisdiction-of-french-courts-over-crimes-against-humanity-9-feb-2022\" rel=\"noopener noreferrer\">France\u2019s commitment<\/a>\u00a0to hold those responsible for grave crimes to account.<\/p>\n<\/p>\n<p>Kunti K. is accused of crimes against humanity committed during the first Liberian civil war, which devasted the country from 1989 to 1996. Liberia\u2019s first civil war was marked by\u00a0<span aria-label=\"Explain glossary term war crimes\" data-tooltip=\"War crimes are serious violations of international humanitarian law committed by individuals with criminal intent. Criminal intent means the violation was carried out deliberately or recklessly. Individuals who order, assist, and aid and abet offenses are also responsible for war crimes.\" title=\"war crimes\">war crimes<\/span>\u00a0and widespread, systematic human rights violations, including profound and disturbing patterns of violence against civilians, as warring factions massacred and raped civilians, pillaged, and forced children to kill and fight. The full name of the accused has been withheld by French officials in line with national privacy laws.<\/p>\n<p>\u201cThis trial is an important step for justice for victims amid the failure of Liberian authorities to hold to account those responsible for serious crimes during the civil wars,\u201d said\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/about\/people\/elise-keppler\" rel=\"noopener\">Elise Keppler<\/a>, associate international justice director at Human Rights Watch. \u201cLiberian authorities should take note: these crimes can and should be prosecuted, and a long-recommended war crimes court should be established in-country without delay.\u201d<\/p>\n<p>The organization\u00a0<a target=\"_blank\" href=\"https:\/\/civitas-maxima.org\/\" rel=\"noopener noreferrer\">Civitas Maxima<\/a>\u00a0filed a\u00a0<a target=\"_blank\" href=\"https:\/\/civitas-maxima.org\/2018\/09\/07\/suspect-of-crimes-against-humanity-arrested-in-france\/\" rel=\"noopener noreferrer\">criminal complaint<\/a>\u00a0in France against Kunti K. in 2018, following which he was arrested in Paris on suspicion of crimes against humanity and torture. Ahead of the trial, Human Rights Watch and FIDH published a\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2022\/10\/05\/frances-trial-atrocities-committed-liberia\" rel=\"noopener\">question-and-answer<\/a>\u00a0document with information on:<\/p>\n<\/p>\n<ul>\n<li>the accused, Kunti K.;<\/li>\n<li>the Liberian civil wars;<\/li>\n<li>the lack of accountability in Liberia for serious crimes committed, and need for Liberia to create a war crimes court with the assistance of its international partners and;<\/li>\n<li>the significance of the trial and legal restrictions in France linked to the prosecution of serious crimes committed abroad.<\/li>\n<\/ul>\n<p>Kunti K.\u2019s trial in France is possible because the country\u2019s laws recognize universal jurisdiction over the most serious crimes under international law. Universal jurisdiction allows for investigating and prosecuting these crimes no matter where they were committed, and regardless of the nationality of the suspects or victims. This, and other universal jurisdiction cases in Europe and the US on Liberian civil wars-era crimes, have been the only chance so far for Liberian\u00a0<a target=\"_blank\" href=\"https:\/\/www.fidh.org\/IMG\/pdf\/breaking_down_barriers_en_web.pdf\" rel=\"noopener noreferrer\">victims<\/a>\u00a0to see justice done.<\/p>\n<p>The use of universal jurisdiction in France is, however,\u00a0<a target=\"_blank\" href=\"https:\/\/www.amnesty.fr\/actualites\/competence-universelle-france-ukraine-justice-internationale-cpi#:~:text=les%20plus%20graves\" rel=\"noopener noreferrer\">restricted<\/a>\u00a0by multiple legal barriers, the groups said.
