{"id":81690,"date":"2022-02-07T19:00:17","date_gmt":"2022-02-07T17:00:17","guid":{"rendered":"https:\/\/southafricatoday.net\/africa-news\/central-africa\/dr-congo\/dr-congo-sham-trial-for-murders-of-un-experts\/"},"modified":"2022-02-07T19:00:18","modified_gmt":"2022-02-07T17:00:18","slug":"dr-congo-sham-trial-for-murders-of-un-experts","status":"publish","type":"post","link":"https:\/\/southafricatoday.net\/africa-news\/central-africa\/dr-congo\/dr-congo-sham-trial-for-murders-of-un-experts\/","title":{"rendered":"DR Congo: Sham Trial for Murders of UN Experts"},"content":{"rendered":"<p><a target=\"_blank\" href=\"https:\/\/southafricatoday.net\/africa-news\/wp-content\/uploads\/2018\/10\/60d80c333445d54\" rel=\"noopener\"><\/a><br \/><a target=\"_blank\" href=\"https:\/\/www.africa-newsroom.com\/files\/download\/60d80c333445d54\" rel=\"noopener\">Download logo<\/a><\/p>\n<p>A four-year trial in the\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/africa\/democratic-republic-congo\" rel=\"noopener\">Democratic Republic of Congo<\/a>\u00a0failed to uncover the full truth about the 2017 murders of two United Nations investigators, Zaida Catal\u00e1n and Michael Sharp, and the fate of their Congolese interpreter and motorbike drivers, Human Rights Watch said today.<\/p>\n<\/p>\n<p>Despite UN assistance, the court\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2021\/03\/12\/dr-congo-probe-state-role-un-experts-murder-0\" rel=\"noopener\">ignored<\/a>\u00a0leads pointing to the involvement of senior Congolese officials. The United Nations, United States, and Sweden should urgently open a credible international inquiry into the killings and the role of Congolese officials.<\/p>\n<p>\u201cThroughout the four-year trial, the prosecution never examined who planned and ordered the killing of the UN experts,\u201d said\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/about\/people\/thomas-fessy\" rel=\"noopener\">Thomas Fessy<\/a>, senior Congo researcher at Human Rights Watch. \u201cThe UN, US, and Sweden should acknowledge Congo\u2019s failure to adequately investigate this crime and urgently lead a new and credible international inquiry into state responsibility for the murders.\u201d<\/p>\n<p>On January 29, 2022, a military court in Kananga\u00a0<a target=\"_blank\" href=\"https:\/\/www.reuters.com\/world\/africa\/dozens-sentenced-death-over-murders-un-experts-congo-2022-01-29\/\" rel=\"noopener noreferrer\">sentenced<\/a>\u00a0to death 49 defendants, many\u00a0<em>in absentia<\/em>, on various charges, including terrorism, murder, and the war crime of mutilation. An army officer Col. Jean de Dieu Mambweni was\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2022\/01\/29\/meurtre-des-experts-de-lonu-le-colonel-jean-de-dieu-mambweni-reconnu-coupable-de\" rel=\"noopener noreferrer\">sentenced<\/a>\u00a0to 10 years in prison for disobeying orders. A local immigration officer, Thomas Nkashama, was among those sentenced to death. Two defendants were\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2022\/01\/29\/meurtre-des-experts-de-lonu-le-journaliste-trudon-raphael-kapuku-et-le-policier-police\" rel=\"noopener noreferrer\">acquitted<\/a>. Human Rights Watch has yet to be able to see the full 146-page verdict.<\/p>\n<p>On March 12, 2017, unidentified assailants\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2017\/03\/28\/dr-congo-bodies-two-un-experts-found\" rel=\"noopener\">summarily executed<\/a>\u00a0Catal\u00e1n, a Swede, and Sharp, an American, while they were documenting serious rights abuses and other UN sanctions violations in Kasai Central province for a UN Security Council\u00a0<a target=\"_blank\" href=\"https:\/\/www.un.org\/securitycouncil\/sanctions\/1533\/work-and-mandate\" rel=\"noopener noreferrer\">expert panel<\/a>. UN peacekeepers found their bodies two weeks later near the village of Bunkonde. Their Congolese interpreter, Betu Tshintela, is still missing as are three motorbike drivers who accompanied them, Isaac Kabuayi, Pascal Nzala, and Moise (surname unknown). The trial began in June 2017 before a military court in Kananga, the provincial capital, and a\u00a0<a target=\"_blank\" href=\"https:\/\/www.securitycouncilreport.org\/atf\/cf\/%7B65BFCF9B-6D27-4E9C-8CD3-CF6E4FF96FF9%7D\/s_2017_917.pdf\" rel=\"noopener noreferrer\">UN team<\/a>, known as the Follow-on Mechanism, has been providing support and advice.<\/p>\n<p>Violence tied to customary control over local chieftaincies\u00a0<a target=\"_blank\" href=\"http:\/\/congoresearchgroup.org\/new-crg-report-crisis-in-kasai\/\" rel=\"noopener noreferrer\">erupted in the Kasai region in 2016<\/a>. The conflict was linked to national political dynamics, with the Congolese army backing the leadership of people considered loyal to then-President Joseph Kabila and his political coalition, and some militia groups supporting those closer to the opposition. Over the course of the violence, hundreds of people were killed and over 200,000 people were displaced from their homes.<\/p>\n<p>Kabila\u2019s government initially\u00a0<a target=\"_blank\" href=\"http:\/\/www.rfi.fr\/fr\/afrique\/20170424-rdc-assassinat-deux-experts-onu-kasai-video-kamwina-nsapu-catalan-sharp\" rel=\"noopener noreferrer\">blamed<\/a>\u00a0the Kamuina Nsapu militia for the murders of Catal\u00e1n and Sharp, but mounting evidence has pointed to the role of high-level state officials, including through reporting by\u00a0<a target=\"_blank\" href=\"http:\/\/webdoc.rfi.fr\/rdc-kasai-violences-crimes-kamuina-nsapu\/chap-04\/index.html\" rel=\"noopener noreferrer\">Radio France Internationale (RFI)<\/a>\u00a0and\u00a0<a target=\"_blank\" href=\"https:\/\/www.reuters.com\/article\/us-congo-violence-un\/who-killed-u-n-experts-in-congo-confidential-prosecutors-file-offers-clues-idUSKBN1EE0CT\" rel=\"noopener noreferrer\">Reuters<\/a>.\u00a0A joint investigation by five international media outlets known as \u201c<a target=\"_blank\" href=\"https:\/\/foreignpolicy.com\/2018\/11\/27\/congolese-cover-up-un-congo-murder-zaida-catalan-michael-sharp\/\" rel=\"noopener noreferrer\">Congo Files<\/a>,\u201d based on thousands of pages of leaked internal UN documents and interviews with dozens of key players, alleged that a UN team examining the murders covered up evidence suggesting that senior Congolese authorities may have been involved.<\/p>\n<p>Throughout the four years of court hearings, the prosecution, assisted by the UN Follow-on Mechanism, never fully explored the participation of government authorities, continually blaming militiamen. As a result, full responsibility for the killings was not established, Human Rights Watch said.<\/p>\n<p>On January 31, the military prosecutor, Col. Jean-Blaise Bwamulundu,\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2022\/01\/31\/meurtre-des-experts-de-lonu-lauditorat-general-va-en-appel-contre-le-jugement-de-la-cour\" rel=\"noopener noreferrer\">announced<\/a>\u00a0the state\u2019s intention to appeal the verdict given Congo\u2019s moratorium on the death penalty, and stated that investigations would continue to ensure that others involved would be brought to justice. Human Rights Watch opposes the death penalty in all circumstances because of its inherent cruelty.<\/p>\n<p>President\u00a0Felix\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/USAmbDRC\/status\/1236347193335914500\" rel=\"noopener noreferrer\">Tshisekedi previously said in meetings<\/a>\u00a0with Human Rights Watch, senior US officials, and others that he was committed to ensuring that the full truth was uncovered and that those most responsible for the murders were held to account. However, the trial showed that Congo\u2019s judiciary was unable to provide real justice in this case, Human Rights Watch said.<\/p>\n<p>The Kananga trial was marked by\u00a0<a target=\"_blank\" href=\"https:\/\/www.rfi.fr\/fr\/afrique\/20190329-experts-onu-tues-rdc-irregularites-deroulement-proces\" rel=\"noopener noreferrer\">slow proceedings<\/a>, and was suspended between March and October 2020 due to the Covid-19 pandemic. Out of more than 50 defendants, only a dozen were directly cited during the hearings. Some remain at large while two defendants\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/index.php\/2019\/10\/22\/meurtre-des-experts-de-lonu-un-troisieme-prevenu-meurt-en-detention\" rel=\"noopener noreferrer\">died in detention<\/a>\u00a0in suspicious circumstances. At least three other defendants alleged that they were tortured by police and at the national intelligence agency headquarters. Others\u00a0<a target=\"_blank\" href=\"https:\/\/www.reuters.com\/article\/us-congo-violence-un-idUSKCN1SD1A7\" rel=\"noopener noreferrer\">escaped<\/a>\u00a0from Kananga prison in May 2019 and have not been apprehended.<\/p>\n<p>The\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2020\/03\/11\/actualite\/justice\/proces-du-meurtre-des-experts-de-lonu-laudience-renvoyee-la-suite-de\" rel=\"noopener noreferrer\">lack of legal representation<\/a>\u00a0for defendants in violation of their basic right to counsel also led to numerous delays in the proceedings, while Congolese security services allegedly\u00a0<a target=\"_blank\" href=\"https:\/\/www.undocs.org\/S\/2018\/531\" rel=\"noopener noreferrer\">interfered with the investigation<\/a>.<\/p>\n<p>A Congolese journalist, Sosthene Kambidi, who has long investigated the violence in Kasai with international media and organizations, was\u00a0<a target=\"_blank\" href=\"https:\/\/www.rfi.fr\/fr\/afrique\/20210922-rdc-le-journaliste-sosth%C3%A8ne-kambidi-arr%C3%AAt%C3%A9-pour-son-enqu%C3%AAte-sur-l-assassinat-des-experts-de-l-onu\" rel=\"noopener noreferrer\">arrested<\/a>\u00a0on September 21, 2021, and\u00a0<a target=\"_blank\" href=\"https:\/\/www.rfi.fr\/fr\/afrique\/20211012-rdc-le-journaliste-sosth%C3%A8ne-kambidi-lib%C3%A9r%C3%A9-apr%C3%A8s-trois-semaines-de-d%C3%A9tention\" rel=\"noopener noreferrer\">detained<\/a>\u00a0for three weeks over the origin of a video, he and others had obtained, that shows the execution of the two UN experts. His arrest\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/thfessy\/status\/1440271994797191175\" rel=\"noopener noreferrer\">caused<\/a>\u00a0a public outcry. He was never charged with a crime.<\/p>\n<p>In August 2017, the UN Group of Experts on Congo, which Catal\u00e1n and Sharp had served on,\u00a0<a target=\"_blank\" href=\"https:\/\/www.securitycouncilreport.org\/atf\/cf\/%7B65BFCF9B-6D27-4E9C-8CD3-CF6E4FF96FF9%7D\/s_2017-672_rev_1.pdf\" rel=\"noopener noreferrer\">recommended<\/a>\u00a0that the Security Council mandate the secretary-general \u201cto establish an independent international investigation\u201d into the murders, but the call went unheeded.<\/p>\n<p>On March 12, 2018, in a\u00a0<a target=\"_blank\" href=\"https:\/\/www.government.se\/statements\/2018\/03\/statement-in-relation-to-the-anniversary-of-the-murder-of-zaida-catalan\/\" rel=\"noopener noreferrer\">statement<\/a>\u00a0marking the one-year anniversary of the murders, Sweden\u2019s administration said that \u201cfurther international investigation may be necessary. And if so, we will call for it and work to ensure it is carried out. No stone should be left unturned in this work.\u201d Four years later, the Swedish government should act on its statement and acknowledge the need for a new and impartial international investigation, Human Rights Watch said. \u00a0<\/p>\n<p>Following the verdicts, Sweden\u2019s foreign affairs minister, Ann Linde,\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/AnnLinde\/status\/1487482746503155721?s=20&amp;t=6azxi8FCAXpRwxIs7Pumuw\" rel=\"noopener noreferrer\">said<\/a>\u00a0it was \u201ccrucial that [an] investigation concerning others involved continue[d] to further uncover truth and bring justice.\u201d On January 30, the US ambassador to Kinshasa, Mike Hammer,\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/USAmbDRC\/status\/1487709743707828226?s=20&amp;t=6azxi8FCAXpRwxIs7Pumuw\" rel=\"noopener noreferrer\">said<\/a>\u00a0that the investigation should continue \u201cinto all possible leads for justice to be fully served.\u201d<\/p>\n<p>\u201cIn order for the truth to emerge, all suspects, including those higher up in the hierarchy, need to be questioned, which has not yet been done,\u201d Elizabeth Morseby, Catal\u00e1n\u2019s sister,\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/LizzyMorseby\/status\/1487696020255526915?s=20&amp;t=6azxi8FCAXpRwxIs7Pumuw\" rel=\"noopener noreferrer\">tweeted<\/a>\u00a0after the verdict.<\/p>\n<p>With the support of the US and Sweden, UN Secretary-General Antonio Guterres should use his authority to open a full-scale international investigation, pursuing leads until all avenues are exhausted, Human Rights Watch said. The US and Sweden should redouble diplomatic efforts to ensure that Congolese authorities and the UN are committed to uncovering the full truth. Congolese authorities, with UN support, should cooperate with the new investigation and ensure that the security of all witnesses and defendants is protected.<\/p>\n<p style=\"clear:both\">\u201cNearly five years on, there are still more questions than answers about those who bear ultimate responsibility for the murders of the UN investigators,\u201d Fessy said. \u201cThe UN\u2019s past failure, along with the US and Sweden, to investigate the deaths of Catal\u00e1n and Sharp was a cynical betrayal.
