width=\"1\" height=\"1\" alt=\"\" title=\"\"><\/p>\n<p>Election-related violence across the\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/africa\/democratic-republic-congo\" rel=\"noopener\">Democratic Republic of Congo<\/a>\u00a0risks undermining general elections scheduled for December 20, 2023, Human Rights Watch said today. Congolese authorities should urgently and impartially investigate violent incidents linked to the elections and prosecute those responsible, regardless of their political affiliation.<\/p>\n<\/p>\n<p>Since early October, Human Rights Watch has documented clashes across the country between supporters of rival political parties that have resulted in assaults, sexual violence, and at least one death. Supporters of the ruling Union for Democracy and Social Progress Party (Union pour la d\u00e9mocratie et le progr\u00e8s social, UDPS) have been implicated in threats and attacks against opposition party leaders and journalists. Opposition supporters have also been implicated in violence. Incidents of\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2023\/12\/13\/actualite\/securite\/echauffourees-au-meeting-de-katumbi-moanda-controverse-entre\" rel=\"noopener noreferrer\">political violence<\/a>\u00a0continue to be reported.<\/p>\n<p>\u201cCongolese authorities need to act urgently to prevent violence before, during, and after the vote, to stop a dangerous situation from getting even worse,\u201d said\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/about\/people\/thomas-fessy\" rel=\"noopener\">Thomas Fessy<\/a>, senior Congo researcher at Human Rights Watch. \u201cPolitical parties and candidates should publicize their anti-violence stance and help ensure that people have the opportunity to vote for the candidates of their choice.\u201d<\/p>\n<p>The elections are for president, members of national and provincial parliaments, and local offices. More than 1.5 million people will not be able to vote in areas of active conflict, mainly in the\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2023\/06\/13\/dr-congo-killings-rapes-rwanda-backed-m23-rebels\" rel=\"noopener\">eastern North Kivu province<\/a>\u00a0but also in the\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2023\/03\/30\/dr-congo-rampant-intercommunal-violence-west\" rel=\"noopener\">western province of Mai-Ndombe<\/a>. Millions of internally displaced people may also not be able to cast their ballots.<\/p>\n<p>Human Rights Watch interviewed 36 people by phone, including victims of violence, their family members, activists, political party members, journalists, medical staff, judicial and security sources, United Nations staff, and election observers.<\/p>\n<p>In one major incident on November 7, supporters of President F\u00e9lix Tshisekedi\u2019s UDPS party\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/11\/08\/affrontements-entre-militants-udps-et-ensemble-kasumbalesa-justicia-asbl-denonce-la\" rel=\"noopener noreferrer\">clashed with<\/a>\u00a0supporters of Mo\u00efse Katumbi\u2019s opposition party, Together for the Republic (Ensemble pour la R\u00e9publique, known as Ensemble), at a rally in Kasumbalesa, in southeastern Haut-Katanga province. Katumbi\u2019s supporters ransacked a local UDPS chapel\u2019s office and UDPS supporters attacked and injured six people, raped at least two women, and sexually assaulted three others, according to witnesses as well as security, medical, and UN sources. Five police officers were injured. The authorities are not known to have investigated the attacks, including the\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2023\/11\/08\/actualite\/securite\/kasumbalesa-plusieurs-blesses-la-suite-des-echauffourees-entre-les\" rel=\"noopener noreferrer\">reports<\/a>\u00a0of physical and\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/tshiswaka5\/status\/1723917792913543569\" rel=\"noopener noreferrer\">sexual violence<\/a>.<\/p>\n<p>On November 13, the Independent National Electoral Commission (Commission \u00c9lectorale Nationale Ind\u00e9pendante, CENI) invited presidential candidates to adopt\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/11\/13\/rdc-ceni-les-candidats-la-presidentielle-seront-invites-signer-un-code-de-bonne-conduite\" rel=\"noopener noreferrer\">a code of conduct<\/a>\u00a0ahead of the official election campaign, which began on November 19. The code of conduct outlines the candidates\u2019 \u201cdetermination to combat all forms of violence in the pre-electoral, electoral, and post-electoral periods.\u201d By signing it, candidates would also commit to \u201crespect[ing] the results of the ballot box and only use the legal channels &#8230; to contest the results.\u201d However,\u00a0<a target=\"_blank\" href=\"https:\/\/www.rfi.fr\/fr\/afrique\/20231114-rdc-plusieurs-candidats-%C3%A0-la-pr%C3%A9sidentielle-refusent-de-signer-le-code-de-bonne-conduite-propos%C3%A9-par-la-c%C3%A9ni\" rel=\"noopener noreferrer\">none of the main presidential candidates<\/a>\u00a0have signed it, some\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/index.php\/2023\/11\/14\/delly-sesanga-au-sujet-des-amendements-apporter-au-code-de-bonne-conduite-il-faut-que-le\" rel=\"noopener noreferrer\">citing a lack of confidence<\/a>\u00a0in the electoral commission and its commitment to a free and fair election.<\/p>\n<p>The violence and heightened tensions have also had an impact on media and journalists. On November 9, national intelligence agents\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/11\/10\/moanda-un-journaliste-arrete-sur-ordre-dun-administrateur-du-territoire#:~:text=Selon%20des%20informations%20recueillies%20par,la%20R%C3%A9publique%2C%20Monsieur%20Matata%20Ponyo.\" rel=\"noopener noreferrer\">arrested<\/a>\u00a0Raphael Ngoma, a journalist from the Moanda Community Radio in Moanda, Kongo Central province. He was detained on orders of the territory administrator, Amina Panda, who\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/rsf_inter\/status\/1723012936526901289?s=48&amp;t=-60MfSqtoGiCkpXeNaW1Ng\" rel=\"noopener noreferrer\">accused<\/a>\u00a0him of broadcasting false information about an opposition rally. He was released the next day without charge.<\/p>\n<p>On December 7, Congolese group Journalist in Danger (Journaliste en Danger, JED)\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/12\/07\/beni-jed-demande-la-protection-dun-journaliste-qui-craint-pour-sa-vie-apres-plusieurs\" rel=\"noopener noreferrer\">said<\/a>\u00a0that John Kanyunyu Kyota, a freelance journalist who collaborates with German broadcaster Deutsche Welle, had been receiving threats by phone for his reporting on the election campaign. Fearing for his safety, Kanyunyu went into hiding.<\/p>\n<p>Addressing the UN Security Council on December 11, the head of the United Nations Stabilization Mission in Congo (Mission de l&#8217;Organisation des Nations Unies pour la stabilisation en R\u00e9publique d\u00e9mocratique du Congo, MONUSCO), Bintou Keita,\u00a0<a target=\"_blank\" href=\"http:\/\/webtv.un.org\/en\/asset\/k1t\/k1t8vtyhpw\" rel=\"noopener noreferrer\">said<\/a>\u00a0that \u201cviolent clashes between supporters of rival political parties [were] occurring in many provinces.\u201d She also said that women political leaders and candidates were experiencing \u201cintimidation as well as physical and verbal misogynistic attacks.\u201d She said she was \u201calarmed by the proliferation of mis- and disinformation as well as hate speech, online and offline, in the context of the electoral campaign.\u201d<\/p>\n<p>Under international human rights law, authorities are obligated to take all reasonable steps to create and maintain an environment in which candidates, citizens, election officials, journalists, and\u00a0<span aria-label=\"Explain glossary term civil society\" data-once=\"enable_tooltips\" data-tooltip=\"Civil society usually refers to a broad array of nongovernmental organizations including: community and grassroots groups, advocacy organizations, religious-based groups, labor unions, and many others. Civil society typically does what the government or businesses cannot or won\u2019t do, such as providing direct services or advocating for changes in the laws and government practices.\" title=\"civil society\">civil society<\/span>\u00a0activists can operate free from violence and intimidation. Democratic elections require the protection of freedom of expression and access to information. The UN Special Rapporteur on the right to freedom of opinion and expression has issued\u00a0<a target=\"_blank\" href=\"https:\/\/icj2.wpenginepowered.com\/wp-content\/uploads\/2015\/02\/Report-SRFoE-2014-eng.pdf\" rel=\"noopener noreferrer\">detailed guidance<\/a>\u00a0on how to ensure freedom of opinion, expression, and access to information during elections.<\/p>\n<p>The Congolese authorities should ensure the security and safety of all election observers operating in the country. Elections officials should publish the results by polling place, both at voting centers and on its website, as required by law, to deter any post-election violence and abuses, Human Rights Watch said.<\/p>\n<p>\u201cCongolese citizens across the country should be able to exercise their right to vote safely,\u201d Fessy said. \u201cWith the credibility of the electoral process at stake, Congolese authorities should put in place comprehensive plans to protect voters, candidates, election officials, observers, and journalists.\u201d<\/p>\n<p><strong>For additional details and accounts please see below.\u00a0<\/strong><\/p>\n<p><strong>The Violence in Kasumbalesa<\/strong><\/p>\n<p>On November 4, a ruling UDPS official known as \u201cLion\u2019s Heart\u201d warned Katumbi, the Ensemble presidential candidate, that he would risk \u201cgetting beaten up\u201d if he campaigned in Kasumbalesa, a border town in southeastern Haut-Katanga province. \u201cIf he gets to Kasumbalesa, he&#8217;ll face the biceps of \u2026\u00a0<em>Fatshi b\u00e9ton<\/em>\u2019s children,\u201d the official said, using President Tshisekedi\u2019s nickname. The threatening speech,\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/mwandochris\/status\/1720867316643004487?t=zkflxGUXfpSi3O0mzCT01g\" rel=\"noopener noreferrer\">filmed during a UDPS rally<\/a>, was widely circulated.<\/p>\n<p>The following day, a provincial youth movement supporting Katumbi responded with heinous ethnic-based statements aimed at UDPS supporters, whose strongholds are in the Kasa\u00ef provinces. \u201cWe followed the UDPS communication that forbids a son of Katanga, the son of a Katangan native to enter his house,\u201d the youth movement said. \u201cIf they want to challenge us at home [in Katanga], we&#8217;ll also have to show that we&#8217;re natives. We will be going to Kasumbalesa next week and we want to see who can stop us.\u201d<\/p>\n<p>Human Rights Watch\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2011\/10\/28\/dr-congo-candidates-should-not-incite-violence\" rel=\"noopener\">previously<\/a>\u00a0documented ethnic tensions fueled by leaders of the neighboring Katanga and Kasai provinces during the 2011 elections, using hate speech and incitement to violence. These tensions have their roots in\u00a0<a target=\"_blank\" href=\"https:\/\/dpl.pole-institute.org\/sites\/default\/files\/pdf_publication\/Rapport_katanga_Pole.pdf\" rel=\"noopener noreferrer\">historical migration movements<\/a>\u00a0between the provinces. In the early 1990s, the then-Katangan authorities forcibly expelled hundreds of thousands of Kasaians from the province and thousands died.<\/p>\n<p>On November 7, Ensemble supporters held a rally in Kasumbalesa. Rival UDPS supporters\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/11\/08\/affrontements-entre-militants-udps-et-ensemble-kasumbalesa-justicia-asbl-denonce-la\" rel=\"noopener noreferrer\">attacked<\/a>\u00a0the rally armed with wooden sticks. As the rally grew in numbers, crowds fought off the UDPS supporters.<\/p>\n<p>After the rally, Ensemble supporters ransacked the local UDPS headquarters, triggering scuffles between the two groups. \u201cAngry UDPS supporters attacked those of Ensemble, in particular the women,\u201d a witness said. \u201cI saw two women &#8230; They were stripped naked, beaten up, and groped. If the police hadn&#8217;t intervened, their situation would have been worse.\u201d<\/p>\n<p>A Congolese police officer deployed at the scene said that the police helped two women who had been stripped naked and sexually assaulted to escape the attackers. The officer said the police were understaffed and lacked adequate equipment to contain violent crowds. \u201cIf protesters use rocks, we also use rocks,\u201d he said. \u201cIf they use sticks, we do the same.\u201d<\/p>\n<p>A 51-year-old woman told Human Rights Watch that she had been beaten and raped: <em>&#8220;My comrades and I were wearing T-shirts bearing the Ensemble insignia. After the rally, I was on my way to buy things to sell when I encountered a group of UDPS supporters who rushed at me and started beating me with sticks. I regained consciousness in the hospital, where I found myself with torn clothes. The doctor told me that I had been penetrated with a stick into my vagina.&#8221;<\/em><\/p>\n<p>During the incident, assailants raped at least one other woman and stripped and groped three more, according to a witness and security, medical, and UN sources.<\/p>\n<p>The authorities should promptly and impartially investigate the attacks and sexual violence and appropriately prosecute those found responsible. The authorities should ensure victims of sexual violence receive adequate medical and psychosocial care.<\/p>\n<p><strong>Other Election-Related Cases<\/strong><\/p>\n<p>On November 28, in the city of Kindu, an SUV apparently owned by Provincial Governor Afani Idrissa Mangala\u2019s campaign team struck and killed Dido Kakisingi, 38, Katumbi\u2019s youth league president for the eastern Maniema province. UDPS supporters initially attempted to block Katumbi\u2019s convoy and a crowd of his supporters on one of the city\u2019s main thoroughfares, and Kakisingi requested assistance from security forces to clear the path. UDPS supporters then threw rocks at the convoy, injuring Kakisingi. A white SUV bearing the governor\u2019s campaign ads and a UDPS flag then hit him, killing him. The police\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2023\/11\/28\/actualite\/politique\/campagne-electorale-kindu-un-mort-et-des-blesses-lors-des\" rel=\"noopener noreferrer\">fired warning shots<\/a>\u00a0to disperse the crowds as tension escalated among rival supporters.<\/p>\n<p>The authorities made two arrests in connection with Kakisingi\u2019s death, according to judicial sources, but the investigation is stalling because of alleged political interference. \u201cThe public prosecutor\u2019s office requested an autopsy,\u201d a family member said. \u201cBut they refused to share the results with us.\u201d<\/p>\n<p>On November 4, people believed to be UDPS supporters\u00a0<a target=\"_blank\" href=\"https:\/\/www.rfi.fr\/fr\/afrique\/20231106-rdc-indignation-apr%C3%A8s-le-caillassage-du-cort%C3%A8ge-de-martin-fayulu-dans-le-kasa%C3%AF\" rel=\"noopener noreferrer\">attacked<\/a>\u00a0the convoy of the opposition presidential candidate Martin Fayulu. Fayulu and his supporters were heading to a pre-campaign rally in Tshikapa, Kasa\u00ef province. At least two people and one policeman were injured by rocks thrown at them. President Tshisekedi\u2019s spokesperson, in a statement,\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2023\/11\/06\/emissions\/dialogue-entre-congolais\/felix-tshisekedi-condamne-lattaque-contre-le-cortege\" rel=\"noopener noreferrer\">condemned<\/a>\u00a0such \u201cantidemocratic acts\u201d and \u201cregrett[ed] the political intolerance\u201d that led to the incident.<\/p>\n<p>On October 24, the provincial governor of Kasa\u00ef-Central, John Kabeya, a UDPS member, said at a rally that \u201cif you want to get votes, go to other provinces, but here in Kasa\u00ef-Central, it is Tshilombo\u2019s,\u201d a reference to President Tshisekedi, who comes from the province. The government\u2019s Communication and Broadcasting Board (Conseil sup\u00e9rieur de l&#8217;audiovisuel et de la communication, CSAC), which ensures press freedom as well as equal media access to candidates, said that Kabeya&#8217;s statement was a \u201cspeech of shame\u201d that \u201cincit[ed] ethnic-regional hatred, exclusion, and discrimination,\u201d banning its broadcast.<\/p>\n<p>On November 18, police\u00a0<a target=\"_blank\" href=\"https:\/\/www.adiac-congo.com\/content\/lubumbashi-abel-augustin-amundala-arrete-par-la-police-153115#:~:text=Selon%20Justicia%2C%20association%20%C3%A0%20but,de%20son%20%C3%A9quipe%20de%20campagne.\" rel=\"noopener noreferrer\">arrested<\/a>\u00a0Abel Amundala, Ensemble\u2019s deputy youth leader and parliamentary candidate along with six members of his campaign team during a political meeting in Lubumbashi, Haut-Katanga province. Amundala said that they were taken to the police station and interrogated about their meeting. The police released them two hours later without charge.<\/p>\n<p>On November 20, in Ngandajika, Lomami province, UDPS supporters\u00a0<a target=\"_blank\" href=\"https:\/\/x.com\/tshiswaka5\/status\/1727195480549888193?s=48&amp;t=-60MfSqtoGiCkpXeNaW1Ng\" rel=\"noopener noreferrer\">attacked<\/a>\u00a0an Ensemble campaign convoy of trucks and motorcycles. UDPS supporters burned the motorcycle of Pierre Kaneka, Ensemble\u2019s senior local official. Kaneka said that the police stationed nearby did not intervene. He said that almost simultaneously, another group of UDPS supporters attacked his residence, forcing his wife to flee. Later that night, UDPS supporters ransacked Ensemble\u2019s local headquarters. Kaneka said he has filed a complaint and that one person allegedly involved in the attack had been arrested. Kaneka went into hiding for fear of reprisals.<\/p>\n<p><strong>International Concern<\/strong><\/p>\n<p>The African Union and the Southern African Development Community (SADC) have both\u00a0<a target=\"_blank\" href=\"https:\/\/www.radiookapi.net\/2023\/12\/12\/actualite\/politique\/elections-2023-lunion-africaine-annonce-le-deploiement-de-sa-mission#:~:text=La%20mission%20d&#039;observation%20%C3%A9lectorale,g%C3%A9n%C3%A9rales%20du%2020%20d%C3%A9cembre%202023\" rel=\"noopener noreferrer\">deployed electoral observation missions<\/a>\u00a0to Congo. The Southern African Mission\u00a0<a target=\"_blank\" href=\"https:\/\/www.sadc.int\/node\/5177#:~:text=The%20SEOM%20willbe%20deployed%20to,Democratic%20Elections%20of%20(2021).\" rel=\"noopener noreferrer\">reiterated<\/a>\u00a0the SADC Principles and Guidelines Governing Democratic Elections that \u201cemphasize the implementation of measures to prevent political violence, intimidation, and intolerance.\u201d<\/p>\n<p>In a November statement issued just days before the start of the official electoral campaign, the\u00a0<a target=\"_blank\" href=\"https:\/\/actualite.cd\/2023\/11\/16\/rdc-les-usa-menacent-de-sanctionner-ceux-qui-seront-impliques-dans-la-fraude-electorale#:~:text=Les%20%C3%89tats%2DUnis%20ont%20soulign%C3%A9%20que%20la%20responsabilit%C3%A9%20de%20garantir,pendant%20et%20apr%C3%A8s%20les%20%C3%A9lections.\" rel=\"noopener noreferrer\">U<\/a>nited States government\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/usembkinshasa\/status\/1725178327235781045?t=zkflxGUXfpSi3O0mzCT01g\" rel=\"noopener noreferrer\">called<\/a>\u00a0for a peaceful electoral process and said it would consider imposing targeted sanctions \u201cagainst those who undermine democracy in [Congo].\u201d<\/p>\n<p>On December 8, the European Union\u00a0<a target=\"_blank\" href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2023\/12\/08\/democratic-republic-of-the-congo-council-renews-eu-restrictive-measures-for-one-year\/\" rel=\"noopener noreferrer\">warned<\/a>\u00a0it would impose targeted sanctions against \u201cany person obstructing a consensual and peaceful solution towards the upcoming elections, including by acts of violence, repression or inciting violence, or by undermining the rule of law or involved in serious human rights violations or abuses.\u201d The EU\u00a0<a target=\"_blank\" href=\"https:\/\/www.reuters.com\/world\/europe\/eu-cancels-congo-election-observation-mission-2023-11-29\/#:~:text=BRUSSELS%2FKINSHASA%2C%20Nov%2030%20(,the%20country%20for%20security%20reasons.\" rel=\"noopener noreferrer\">cancelled<\/a>\u00a0its countrywide observation mission after the Congolese authorities did not authorize the use of satellite equipment for its deployment.
