The Western Cape High Court ruled on Tuesday morning, 30 June 2015, on the future of the 16 year old axe-victim from Stellenbosch, and ordered that she remains in the care of her uncle and aunt.

The application in respect of Marli van Breda’s guardianship and future care was filed on Tuesday morning before Judge Siraj Desai in the Western Cape High Court, according to advocate Louise Buikman SC, Marli’s lawyer and curator.

This follows after Buikman submitted a report on Marli’s progress and her recommendations on the teen’s future care to the court on Monday morning.

The report also motivates Buikman’s support on a decision that is taken by Marli’s relatives about her future care until she is 18 years old.

According to Buikman she recommended that Marli remains in the care of her uncle and aunt in the Western Cape. The family also agreed that Buikman should stay on as Marli’s curator to assist her with all lawsuits, and all important decisions on matters such as her schooling and therapy in consultation with her family, teachers and therapists.

Judge Desai ordered on Tuesday that the report on Marli must remain in safekeeping with the registrar. Buikman must, before Marli turns 18, report to the court about the teenager’s progress. The court will then decide whether she needs a curator to help her.

Marli’s parents, Martin (54) and Teresa (55), and her older brother, Rudi (22), were killed on 27 January this year in an axe attack in their home on the De Zalze golf estate  in Stellenbosch. She miraculously survived the attack after she suffered serious head injuries and had to undergo neurosurgery. Her other brother, Henri (20), only sustained minor scratches in the attack.
